Terms of Use

Article 1 — Purpose

These Terms of Use govern the relationship between KCOS (“KCOS”, “we”, “us”) and users (“you”) regarding access to and use of our website and e-commerce services.

Article 2 — Definitions

• Online Store: the KCOS website and related interfaces enabling purchases of K-beauty products.
• User: anyone accessing the Online Store, whether or not registered.
• Account: a registered user profile used for faster checkout, order history, and preferences.
• Guest: a purchaser who checks out without creating an Account.

Eligibility: By using our Services, you confirm you are of legal age in your jurisdiction and authorised to enter into contracts.

Article 3 — Effect & Modifications

We publish these Terms on our website. We may update them to reflect legal, operational, or security changes. Material changes will be announced at least seven (7) days in advance, or thirty (30) days if they are adverse to users. Continued use after the effective date constitutes acceptance.

Article 4 — Provision of Services

• Display product information and conclude purchase contracts.
• Process payments and deliver goods.
• Provide customer service and other commerce-related functions.

We may update or discontinue items due to availability or technical limitations. Significant changes will be notified.

Article 5 — Service Suspension

We may suspend Services for maintenance, updates, or technical reasons. If suspension substantially affects paid services, we will notify you and provide appropriate remedies except where caused by events beyond our control.

Article 6 — Account Registration

You must provide accurate information. We may refuse, suspend, or terminate Accounts with false or unlawful information, or that violate these Terms.

Article 7 — Account Deletion

You may delete your Account at any time. We may suspend or terminate Accounts involved in fraud, non-payment, abuse, or legal violations.

Article 8 — Notifications

We may contact you by email, on-site notices, or within your Account. General notices to all users may be posted on the website.

Article 9 — Purchase Requests

To place an order, you must select products, provide recipient details, review and accept the applicable policies (including refund/cancellation), and confirm your payment method. By submitting an order, you consent to processing of the data necessary to fulfil it under our Privacy Policy.

Article 10 — Formation of Contract

A contract is formed when we accept your order (e.g., order confirmation email). We may decline orders that breach law, contain incorrect information, or concern restricted products (including hygiene-sensitive goods for minors).

Article 11 — Payment, Prices & Taxes

• We accept cards, PayPal and selected wallets (Apple Pay, Google Pay), and KCOS credits/vouchers where available.
• Prices are shown in the store currency and may exclude/import taxes or duties, which are the customer’s responsibility unless stated otherwise.
• We do not add surcharges based solely on your chosen payment method.

Article 12 — Availability, Pricing & Errors

Products, prices, and promotions are subject to change without notice. We may cancel all or part of an order if an item is unavailable, mispriced, or described in error; in such cases, we will notify you and issue a refund where applicable.

Article 13 — Delivery

Orders are prepared within 1–3 business days and typically dispatched within seven (7) days. Transit times vary by destination and carrier. We will notify you of material delays. Risk of loss passes to you upon delivery to the carrier where permitted by law.

Article 14 — Refunds

If we cannot fulfil your order, we will issue a refund to your original payment method within three (3) business days of confirmation or within statutory timeframes where required.

Article 15 — Cancellations / Cooling-off

• EU/UK consumers: statutory cooling-off period of 14 days from receipt for distance contracts, subject to legal exceptions (e.g., unsealed cosmetics/hygiene products cannot be returned once opened).
• Other regions: you may cancel within 7 days of receipt where permitted by applicable law.
• In addition, KCOS offers a commercial returns window of 30 days for unopened and sealed items in original condition, as described in our Return & Refund Policy.
• If goods are delivered incorrectly or damaged, KCOS covers reasonable return costs.

Article 16 — Promotions, Gift Cards & Credits

• Promotions are subject to their specific terms and limited timeframes.
• Gift cards/credits are redeemable only at KCOS, are non-refundable (except where required by law), and cannot be exchanged for cash.
• We may correct or withdraw promotions in case of abuse or error.

Article 17 — Protection of Personal Information

We process personal data as described in our Privacy Policy. By using the Services, you acknowledge our data practices.

Article 18 — Obligations of KCOS

• Operate lawfully and transparently.
• Maintain appropriate security measures.
• Comply with applicable consumer protection, fair advertising, and e-commerce laws.

Article 19 — User Conduct & Prohibited Uses

• No unlawful, fraudulent, or abusive use of the Services.
• No interference with security or integrity of systems.
• No scraping, reverse engineering, or automated access beyond normal shopping activity.
• No posting of defamatory, obscene, or infringing content.

Article 20 — Reviews & User-Generated Content

By submitting reviews, photos, or comments, you grant KCOS a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content for marketing and operational purposes. You represent that you own or have rights to the content and that it does not infringe third-party rights.

Article 21 — Disclaimers & Limitation of Liability

Except where prohibited by law, the Services are provided “as is” and “as available”. KCOS disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted, KCOS will not be liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under applicable law.

Article 22 — Intellectual Property

All content on the Online Store (text, design, images, trademarks, logos) is owned by or licensed to KCOS and protected by IP laws. You may not reproduce or use it except as necessary to use the Services for personal, non-commercial purposes.

Article 23 — Force Majeure

KCOS is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, labour disputes, acts of government, network failures, or supplier issues.

Article 24 — Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Korea. Disputes shall be submitted to the exclusive jurisdiction of the Seoul Central District Court, unless mandatory consumer law in your country grants you additional rights to bring claims locally. Your statutory consumer rights are not affected.

Article 25 — Miscellaneous

• Severability: if any provision is unlawful, the remainder stays in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Assignment: we may assign these Terms in connection with a merger or sale.
• Electronic communications: you agree to receive communications electronically.
• Language: if we provide a translation, the English version governs in case of conflict.
